These Terms of Service ("Terms") are an agreement between you and 360 Data Studio LLC, a Texas limited liability company ("CareRooster", "we", "us"). They cover the CareRooster mobile apps, https://app.carerooster.com and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you use CareRooster for an agency, the Agency Terms also apply.
CareRooster is a scheduling and connection platform for caregivers and home-care agencies. Caregivers manage their schedules and find nearby open shifts. Agencies post shifts and connect with caregivers.
CareRooster is not an employer, staffing agency, home-care provider or referral agency. We do not employ caregivers, provide care, supervise work or set pay. Any work arrangement is solely between a caregiver and an agency. We do not guarantee that any shift will be posted, offered, accepted or filled.
You must be at least 18 and able to enter a binding contract. You agree to give accurate information, including your name, contact details, credentials and availability, and to keep it current. You are responsible for activity on your account and for keeping your login secure.
CareRooster organises schedule information and suggests matches based on factors such as availability, travel time, overtime and preferences. Suggestions are informational. Nothing changes your schedule or commits you to a shift until a person taps to accept it. Before relying on a shift, confirm its details with the agency. You remain responsible for your own work commitments, licensing, training and compliance with law.
Do not enter or upload health information or identifying details about care clients, such as names, addresses, diagnoses or care notes. This includes photos of paper schedules: hide or remove client names before uploading. CareRooster is not designed to store protected health information.
You agree not to post false, misleading or fraudulent shifts, profiles or credentials; harass, threaten or discriminate against anyone; impersonate another person or agency; collect other users' information for purposes unrelated to the Services; interfere with, copy, reverse engineer or overload the Services; or use the Services in violation of any law.
CareRooster has zero tolerance for abusive or objectionable content, and accounts that post it are removed. You can report a problem from inside the app, under Privacy and safety, or by writing to support@carerooster.com.
You keep ownership of information you add, such as schedules, availability and messages ("Your Content"). You give CareRooster a non-exclusive, royalty-free licence to host, use and display Your Content only to operate, improve and provide the Services, as described in our Privacy Policy.
The Services are currently free to caregivers, and free to agencies while we launch. If we introduce fees for any feature, we will give advance notice of at least 30 days, and you will not be charged unless you agree.
You can delete your account at any time in the app under Privacy & safety, then Delete my account. We may suspend or close accounts that violate these Terms or create risk for other users. Sections that by their nature should survive, such as 1.9 to 1.12, continue after your account ends.
The Services are provided "as is" and "as available". To the extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not verify or guarantee any user's identity, credentials, background, reliability or conduct, or the accuracy of any schedule or shift information.
To the extent allowed by law, CareRooster is not liable for indirect, incidental, special, consequential or punitive damages, or for lost earnings or profits. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
You agree to defend and indemnify CareRooster against claims arising from your use of the Services, Your Content, or your violation of these Terms or the law.
These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, and both sides consent to the jurisdiction of those courts. Before filing any claim, each side agrees to try to resolve it informally for 30 days by contacting the other.
We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use the Services after that means you accept the updated Terms.
