These add to the Terms of Service and the Privacy Policy. They are what the person who registers an agency accepts on its behalf.
Effective date: 1 November 2026
These Agency Terms apply to any home-care agency, franchise location or organisation ("Agency") that registers on CareRooster. They add to the Terms of Service and Privacy Policy. The person accepting them confirms they are authorised to bind the Agency.
The Agency is solely responsible for holding and maintaining all licences required to operate, including a Texas HHSC Home and Community Support Services Agency licence, where one applies; for recruiting, screening, background checks, training, supervision and credential verification of its caregivers; for employment decisions, classification as employee or contractor, wages, overtime, taxes, benefits, workers' compensation and insurance; and for the care it provides to its clients and compliance with all laws that apply to it, including employment, anti-discrimination and health-privacy laws.
CareRooster does not screen, employ, supervise or place caregivers, and does not guarantee any caregiver's qualifications, availability or performance.
When the Agency registers or invites caregivers, it confirms it has the right to share their contact details with CareRooster for that purpose. Each caregiver controls their own account and can disconnect from an Agency at any time.
Shift and job posts must be accurate, lawful and non-discriminatory, and must reflect real, available work. Posts should include only what a caregiver needs to decide: general area, date and time, care type, and pay if the Agency chooses to share it.
The Agency will not enter, upload or send through CareRooster any protected health information or identifying details of its clients, including names, street addresses, diagnoses, medications or care notes. Client-specific details must be shared directly with the caregiver through the Agency's own systems after the caregiver accepts a shift. CareRooster is not acting as a business associate of the Agency, and no Business Associate Agreement applies unless both parties sign one in writing.
The Agency sees only its own shifts and the schedule information caregivers share with it. The Agency may use caregiver information obtained through CareRooster only to staff and manage shifts and to recruit, and must not sell it or use it for unrelated marketing. Caregivers who find work through CareRooster may work with more than one agency; the Agency will not use CareRooster to enforce exclusivity against them.
Agency features are free to join while we launch, through 25 March 2027. Before any fees apply, CareRooster will give at least 30 days' written notice of the plans and prices. The Agency will be charged only if it chooses a paid plan. Agencies that join during the launch period are eligible for founding-partner pricing as offered at that time.
Each party will keep the other's non-public business information confidential, and use it only for this relationship.
The Agency may stop using CareRooster and close its account at any time. CareRooster may suspend or close an Agency account for violating these Agency Terms, with notice where practical. On closure, the Agency's posts are removed; caregivers keep their own accounts and schedules.
The disclaimers and limitation of liability in the Terms of Service apply. The Agency will defend and indemnify CareRooster against claims arising from its employment practices, the care it provides, its shift posts, or its breach of these Agency Terms or the law.
An Agency may sign a written Agency Participation Agreement that references these Agency Terms. If they conflict, the signed agreement controls for that Agency.
